Commissioner shall review charter school authorizer performance every five years in a manner and form determined by the commissioner, with authority to review more frequently at the commissioner's own initiative or upon request from charter school operators, board members, or interested parties.

Commissioner must use criteria appropriate to each authorizer and its schools, and must consult with authorizers, charter school operators, and other stakeholders when developing review criteria.

Commissioner's review form must use existing department data to minimize duplicate reporting, and cannot fail to credit, withhold points, or penalize authorizers for failing to charter additional schools or for the absence of complaints.

School district authorizers may satisfy all review requirements and related governance requirements by submitting a written promise to comply with the requirements to the commissioner.

Bill is effective July 1, 2021.
