• Establishes same weight thresholds and penalties for fentanyl (including carfentanil and fentanyl analogs) as for heroin across all controlled substance crime classifications.

• For first-degree sale crimes: 10 grams or more of heroin or fentanyl triggers first-degree offense (within 90-day period).

• For first-degree possession crimes: 25 grams or more of heroin or fentanyl triggers first-degree offense.

• For second-degree sale and possession crimes: 3 grams or more (sale) and 6 grams or more (possession) of heroin or fentanyl apply the same thresholds.

• Excludes fentanyl detection products from drug paraphernalia definition and makes changes effective August 1, 2021 for crimes committed on or after that date.
