Commissioner of corrections may conditionally release pregnant inmates for the duration of pregnancy and up to one year postpartum to participate in community-based programming.

Commissioner may conditionally release inmates who gave birth within eight months of commitment for up to one year postpartum to participate in community-based programming.

Released inmates may participate in prenatal or postnatal care, mother-child bonding programs, evidence-based parenting skills programming, paid employment, vocational training, educational programs, and chemical dependency or mental health treatment services.

Commissioner shall develop policy and criteria for implementation according to public safety and generally accepted correctional practice.

Commissioner must report annually by April 1 to legislative committees with corrections jurisdiction on the number of inmates released and duration of releases under this provision for the prior calendar year.
