S.F. No. 1781 Summary

• Amends Minnesota Statutes to allow cities of the first class to require dedication of land or impose dedication fees in conjunction with construction permits for new housing units and commercial/industrial development, effective August 1, 2021.

• Cash fees may be set based on current land prices at the time permit issuance or as a flat fee rate per net new residential unit, with municipalities required to place funds in a special account for parks, recreational facilities, trails, wetlands, and open space acquisition and development only.

• Ordinances may exempt senior housing and affordable housing applicants from dedication or fee requirements, and municipalities must have a capital improvement budget and parks/open space plan before imposing such requirements.

• Previously subdivided property being resubdivided with the same number of lots is exempt from park dedication; if lot numbers increase, fees apply only to the net increase.

• Applies specific provisions to Minneapolis and St. Paul, allowing their respective park boards/city councils to jointly impose dedication requirements through ordinance.
