Commissioner of human services may issue new community residential setting licenses to replace assisted living facility licenses until June 30, 2024, but only for former customized living services settings that served five or fewer people in a single-family home and were operational on or before June 30, 2021.

Commissioner shall accept the commissioner of health's determination of substantial compliance with assisted living facility requirements as sufficient evidence of compliance with community residential setting standards, waiving additional on-site licensing inspections for eligible applicants.

Commissioner shall establish a competitive grant program awarding grants to trade associations representing small residential service providers to contact and assist customized living services providers with five or fewer licensed residents in determining eligibility for licensure.

Grantee contracts must require the commissioner of human services to provide dedicated staff for technical assistance to grantees and potential license applicants.

Unspecified amount from the general fund is appropriated in fiscal year 2023 to the commissioner of human services for the competitive grants program as a one-time appropriation.
