SF3816 Summary: Long-Term Care Consultation Services Recodification

• Reorganizes long-term care consultation service provisions by moving assisted living counseling services from section 256B.0911 subdivisions 3c-3e to section 256.975 subdivisions 7e-7g, and consolidating other assessment and service planning requirements into new subdivisions of 256B.0911.

• Establishes MnCHOICES assessor qualifications and certification requirements including minimum education standards (bachelor's degree in social work, nursing, or related field), mandates training and recertification every three years, and requires certified assessors to demonstrate person-centered planning principles.

• Defines long-term care consultation services to include intake, assessment, person-centered planning, eligibility determinations for waivers and state plan services, level of care determinations, transition assistance, and informed choice counseling regarding employment, independent living, and self-directed service options.

• Specifies assessment and reassessment timelines and requirements including 20-calendar-day response times for assessments, validity periods of 60 days, annual reassessments, and allowances for remote reassessments under specific conditions with in-person visits required at least periodically.

• Effective date of July 1, 2022 for all provisions; includes transition instructions for the commissioner to update references in printed materials, online documents, and waiver plans during normal course of business.
