SF 3860 - "Never Again Bill" Summary

• Limits peacetime emergency declarations to five days without legislative approval via joint resolution of both houses, which can extend emergency up to 30 days, and requires governor to call legislature into session if extension beyond 30 days is needed.

• Requires governor's emergency orders and rules to be enacted into law by the legislature within five days of taking effect to have full force and effect of law during declared emergencies.

• Defines "public health emergency" narrowly to include only bioterrorism or new, novel, or previously controlled/eradicated airborne infectious agents that pose high probability of mass deaths, serious disabilities, or widespread toxic exposure.

• Prohibits governor and commissioners from suspending business licenses for non-compliance with emergency orders or rules, and prevents violation of state or federal constitutional rights during declared emergencies.

• Repeals criminal penalties for violations of emergency management orders and rules, removing misdemeanor penalties of up to $1,000 fine or 90 days imprisonment.
