SF 3909 Summary

• Amends immediate suspension expedited hearing procedures to require the commissioner to determine within 90 days whether to issue a final licensing sanction or whether ongoing investigations necessitate a suspension order to remain in effect.

• Modifies alcohol and drug treatment program staff qualification requirements, reducing minimum sobriety periods from 2 years to 1 year for most staff and allowing recovery peers with 1 year sobriety (effective January 1, 2023).

• Adds documentation requirements for alcohol and drug treatment programs, including mandatory recording of treatment services within 7 days, significant events on the day they occur, and weekly treatment plan reviews (effective August 1, 2022).

• Expands medication administration policies to allow intramuscular injection of naloxone and epinephrine by trained unlicensed staff under nurse supervision.

• Repeals obsolete statutory provisions and Minnesota Rules related to staff substance use qualifications and requires rulemaking to update disciplinary action policies for drug and alcohol violations.
