Maintains the existing prohibition on the Public Utilities Commission issuing certificates of need for construction of new nuclear-powered electric generating plants.

Allows for an exemption to the prohibition for construction of new small-scale nuclear-powered electric generating reactors that generate 100 megawatts or less of electric energy.

Requires certificates of need for additional spent nuclear fuel storage at facilities seeking license extensions to address the impacts of continued operations over the approval period.

Amends Minnesota Statutes 2020, section 216B.243, subdivision 3b and becomes effective the day following final enactment.
