Amends Minnesota Statutes section 122A.50 to require all teacher collective bargaining agreements to include provisions for due process forms and procedures time beginning with the 2022-2023 school year.

Special educators assigned to teach or provide services to students with individualized family service plans or individualized education programs must receive an average of 60 minutes per day for due process forms and procedures duties.

Due process forms and procedures time is in addition to existing preparation time requirements (minimum 5 minutes per 25 minutes of instructional time).

If parties cannot agree on due process time, a default provision applies requiring 60 minutes per day averaged over the week within the student day for special educators.

Districts are not required to add additional due process time if their collective bargaining agreement already provides time equivalent to 300 minutes of due process duties plus required preparation time.
