Amends Minnesota Statutes 2020, section 326B.106, subdivision 1 to allow municipalities to adopt the most recently published new model commercial energy code ASHRAE 90.1 independently of state adoption.

Municipalities may adopt ASHRAE 90.1 until the commissioner adopts a more energy efficient commercial energy code.

Municipalities are prohibited from amending or changing provisions of the most recent ASHRAE 90.1 standard, except they must adopt amendments to the previous version of ASHRAE 90.1 included in the current state-adopted commercial energy code.

The commissioner of commerce may consider energy code support measures for inclusion in technical guidance under section 216B.241, subdivision 1d.

Effective date is the day following final enactment.
