H.F. No. 35 Summary

• Requires oil refinery owners and operators to mandate that contractors and all subcontractors use a skilled and trained workforce when performing construction, alteration, demolition, installation, repair, maintenance, or hazardous material handling work at the refinery site.

• Defines "skilled and trained workforce" as a minimum of 85 percent of employees who are currently registered apprentices, have graduated from, or have completed classroom and work hour requirements for a registered apprenticeship program in their applicable trade.

• Establishes civil penalties of not less than $5,000 nor more than $10,000 for each violation, with each shift constituting a separate violation, to be enforced by the Division of Labor Standards and Commissioner of Labor and Industry.

• Allows persons injured by violations to bring civil actions against oil refinery owners or operators for damages, attorney fees, costs, disbursements, and other appropriate relief.

• Takes effect October 15, 2021.
