Governor may declare peacetime emergency for up to 5 days without legislative approval, extendable by Executive Council resolution for an additional 25 days for a cumulative total of 30 days.

Extensions beyond 30 days require majority vote approval by each house of the legislature, with governor able to propose additional 30-day extensions requiring two-thirds vote of each house.

Legislature may terminate a peacetime emergency extending beyond 30 days and may revoke or rescind any executive order issued by the governor related to a peacetime emergency by majority vote of each house.

Governor prohibited from allowing a peacetime emergency declaration to expire and declaring a new emergency for the same situation to circumvent legislative approval requirements.

If legislature is not in session and governor needs to extend beyond 30 days, governor must provide at least three days' notice to legislative leaders of intent to convene both houses.
