HF 49 Summary

• Requires contractors and subcontractors performing construction, alteration, demolition, installation, repair, maintenance, or hazardous material handling work at petroleum refineries to use a skilled and trained workforce meeting registered apprenticeship standards.

• Establishes a phased implementation schedule: 65 percent of workforce by October 15, 2022; 75 percent by October 15, 2023; and 85 percent by October 15, 2024.

• Defines "skilled and trained workforce" as employees who are currently registered apprentices, have graduated from a registered apprenticeship program, or have completed all classroom and work hour requirements in an applicable trade.

• Imposes civil penalties of $5,000 to $10,000 per violation on owners, operators, contractors, or subcontractors, with each shift constituting a separate violation.

• Allows injured persons to bring civil actions against refinery owners or operators for damages, attorney fees, costs, and other appropriate relief.
