HF 60 Summary

• Makes selling or possessing an unlawfully possessed firearm suppressor a felony, with sentences of up to 5 years imprisonment or $10,000 fine if committed in public housing zones, school zones, or park zones; otherwise up to 2 years imprisonment or $5,000 fine; effective August 1, 2021.

• Declares that firearm suppressors manufactured entirely within Minnesota from basic materials and not imported from other states are not subject to federal regulation under interstate commerce authority.

• Requires firearm suppressors manufactured and sold in Minnesota to have "Made in Minnesota" clearly stamped on them.

• Prohibits state and local government entities, including agencies, police departments, and attorneys, from enforcing or allowing enforcement of federal firearm suppressor regulations that impose restrictions not existing under state law.

• Authorizes the attorney general to seek declaratory judgments regarding the constitutionality of intrastate suppressor manufacturing and to enforce compliance through mandamus petitions, with violating entities losing state grant funding for the fiscal year following a final judicial determination.
