Amends Minnesota Statutes section 325D.01, subdivision 5 to modify the definition of "cost" for gasoline sales at retail locations where gasoline is dispensed into passenger automobiles and trucks by consumers.

Defines gasoline "cost" as the average terminal price on the day at the terminal from which the most recent supply was acquired, plus all applicable state and federal excise taxes and fees, plus the lesser of six percent or eight cents.

Repeals Minnesota Statutes section 325D.71, which previously prohibited retailers from offering gasoline for sale below cost as defined in the statute, except for limited promotional periods of no more than three days per calendar quarter.

Eliminates the prohibition on below-cost gasoline sales and removes the Commissioner of Commerce's enforcement authority related to preventing such violations.
