HF 2019 Summary

• Prohibits school districts and charter schools from teaching, advocating for, or encouraging adoption of nine defined "racist or sexist concepts," including claims that one race or sex is inherently superior, that individuals bear responsibility for past actions of their race or sex, or that meritocracy is racist or sexist.

• Prohibits school districts and charter schools from penalizing students who refuse to adopt or express such concepts, hosting speakers who promote such concepts, or requiring students to read or view materials that espouse such concepts.

• Applies identical prohibitions to Minnesota state colleges and universities, restricting faculty instruction and institutional practices regarding the defined concepts.

• Creates private rights of action allowing any state resident to sue school districts, charter schools, or state colleges and universities for violations, with courts authorized to enjoin state funding in the following fiscal year and award costs and attorney fees to the complainant.

• Applies the same definitions and prohibitions to both K-12 schools (Minnesota Statutes Chapter 120B) and higher education institutions (Minnesota Statutes Chapter 136F).
