HF2041 Summary

• Authorizes syringe services providers (cost-free harm reduction programs) to legally possess, distribute, and dispose of syringes and needles effective August 1, 2023.

• Allows participants receiving services from syringe services providers to access and possess new syringes or return used syringes without criminal liability.

• Defines syringe services providers as community-based programs offering sterile injection equipment, safe disposal containers, overdose prevention education, disease testing, and referrals to substance use disorder treatment.

• Repeals the drug paraphernalia possession statute (section 152.092) and removes references to possessing drug paraphernalia from related drug laws, while clarifying that drug paraphernalia rules do not apply to hypodermic needles and syringes distributed by syringe services providers.

• Permits registered pharmacies and licensed pharmacists to sell up to ten unused hypodermic needles and syringes without a prescription, provided they participate in proper disposal programs.
