HF 2215 Summary

• Modifies the community residential setting licensing moratorium by adding new exceptions for customized living settings that were operational on June 30, 2021, under brain injury or community access for disability inclusion waiver plans.

• Requires customized living service providers seeking licenses to demonstrate that case managers provided residents with information about service choices and that licensed services cost no more than existing customized living services.

• Establishes a temporary 21.6 percent rate increase for community access for disability inclusion and brain injury customized living services between July 1, 2023, and June 30, 2025, blended with prior rate methodology.

• Directs the commissioner to expedite processing of pending applications for foster care and community residential setting licenses under the new exceptions and to increase licensed capacity to four for any settings already licensed under the previous exception.

• Effective retroactively from July 1, 2021, with the commissioner directive and rate increase provisions taking effect upon enactment.
