HF 2232 - Nursing Home Moratorium Process

• Commissioners of health and human services must deny requests for new licensed or certified nursing home beds, except through established exceptions or the section 144A.073 process.

• Construction projects exceeding $1,000,000 are prohibited unless costs above that threshold are excluded from the facility's appraised value and reimbursement rate, or the project meets specific exceptions including approval through section 144A.073 or correction of legal violations.

• Phased construction projects must have total estimated costs submitted upfront and considered as a single project; final costs exceeding the threshold will not be recognized in the facility's payment rate.

• Amendments to previously approved projects can include costs up to 10 percent above the original estimate if documented circumstances exist such as natural disasters, unforeseen safety conditions, or changes required by law.

• All construction projects approved through section 144A.073 after January 1, 2020, are subject to fair rental value property rate provisions; effective date is August 1, 2023.
