H.F. No. 2422 Summary

• Amends Minnesota Statutes section 16A.151, subdivision 2 to add paragraph (h) establishing requirements for settlement money related to electronic nicotine delivery systems and youth nicotine use violations.

• Creates a new tobacco use prevention account in the special revenue fund to receive settlement money from attorney general litigation or court orders related to alleged consumer fraud violations in the marketing, sale, or distribution of electronic nicotine delivery systems.

• Appropriates all money in the tobacco use prevention account annually to the commissioner of health for tobacco and electronic delivery device use prevention and cessation projects, public information programs, health education materials, prevention activities, and statewide tobacco cessation services.

• Requires health commissioner to prioritize preventing persons under age 21 from using commercial tobacco, electronic delivery devices, tobacco-related devices, and nicotine delivery products; promote racial and health equity; and use evidence-based or promising practice strategies.

• Exempts attorney fees, costs awarded to the state or Attorney General's Office, and contract or agency attorneys from deposit into the tobacco use prevention account.
