HF 2791 Summary

• Prohibits off-highway vehicle use on state land administered by the Department of Natural Resources and county-administered forest land within state forests, except on specifically designated and posted roads and trails.

• Requires off-highway vehicle trails and routes to exclude Tribal lands or Ceded Territory without Tribal approval, unpaved roads within 300 feet of public waters supporting aquatic life, and unpaved roads within 150 feet of other public waters.

• Makes preparation of an environmental assessment worksheet mandatory for any off-highway vehicle trail construction or expansion, except for rerouting one mile or less of existing trails, effective August 1, 2023.

• Requires the Commissioner of Natural Resources to submit by January 15, 2024, an estimate of signage, mapping, and implementation costs, with intent to fund through the off-road vehicle account in the natural resources fund.

• Repeals existing provisions allowing off-highway vehicle use exceptions by permit and eliminates the "scramble area" designation that permitted unrestricted motor vehicle operation in certain areas.
