HF3063 Summary

• Requires parental consent, court order, or warrant before biological specimens can be collected from minors for DNA analysis, effective August 1, 2024.

• Allows minors whose specimens were collected in violation of parental consent requirements to move court to suppress DNA analysis results and destroy the biological specimen.

• Maintains mandatory DNA collection from adults and juveniles who have been convicted of or had probable cause determination for serious crimes including murder, assault, robbery, kidnapping, sexual conduct, burglary, and related offenses.

• Requires biological specimens be forwarded to the state bureau within 72 hours unless superintendent requires shorter period.

• Repeals existing law that allowed DNA collection without conviction requirements.
