Modifies the opioid prescribing improvement program to establish criteria for opioid prescribing protocols categorized by time intervals: up to 4 days after acute painful events, up to 45 days after acute painful events, and chronic pain lasting longer than 45 days.

Exempts prescribers treating intractable pain, malignant conditions, hospice patients, and those providing opioid use disorder treatment with medications from program requirements.

Creates a waiver process allowing provider groups to exempt their employed or affiliated prescribers from program requirements if their medical director and majority of practitioners have specialty, fellowship, or chronic pain treatment experience, with waivers available beginning July 1, 2023.

Establishes a contingent sunset provision that expires the program July 1, 2024, if the commissioner of management and budget certifies by June 1, 2024, that opioid prescribing rates for medical assistance and MinnesotaCare enrollees do not exceed private sector rates by more than 10 percent for January 21, 2022, through December 31, 2023.

Authorizes the Board of Pharmacy to access the prescription monitoring program database to provide technical assistance to the commissioner in evaluating prescribing rates.
