School districts and charter schools receiving student mental health support staff funding must develop and implement evidence-based mental health screening plans for kindergarten through grade 12 students, effective July 1, 2023.

Parent consent is required before conducting mental health screenings; districts must notify parents of screening purpose and timing, and if results indicate a potential mental health condition, provide parents with results and available resources.

Screening data cannot be used for instructional, academic, or disciplinary decisions and must be destroyed either after parent notification or within 60 days of collection, whichever is earlier, in compliance with data privacy laws.

School districts and charter schools are eligible for student mental health supports revenue to hire two full-time student mental health support staff positions for each 2,000 or fewer students, with funding based on statewide average salaries and benefits, or to contract for mental health services.

An unspecified amount from the general fund is appropriated to the Department of Education in fiscal year 2024 for additional general education aid to support the student mental health supports program, effective July 1, 2023.
