Modifies Minnesota Statutes section 123B.09, subdivision 5b, regarding how school board vacancies are filled by appointment and special election.

Adds new provision that if a vacancy occurs less than two years before the term expires, no special election is required and the board-appointed member serves the remainder of the term.

Adds new provision that if a vacancy occurs less than 90 days before the term expires, the board may choose whether to fill the vacancy by appointment (not required to do so).

Maintains existing requirement that a board appointment becomes effective 30 days after adoption of the resolution, but allows eligible voters to file a petition to reject the appointee if signed by at least 5 percent of district voters within 30 days.

Effective date is July 1, 2024, for all vacancies occurring on or after that date.
