H.F. No. 4442 Summary

• Amends Minnesota Statutes section 256I.04, subdivision 2b, regarding housing support agreements between agencies and providers.

• Requires housing support agreements to be in writing on a commissioner-approved form and specify establishment name, address, license type, bed capacity, per diem and monthly rates, and confirmation that the agreement is subject to sections 256I.01 to 256I.06.

• Mandates providers verify minimum requirements including current licenses, staff qualifications, housing support provision, supplementary services, adverse event reporting, residency requirements, and confirmation that employment hours will not be restricted.

• Allows termination of agreements by the commissioner, agency, or provider with two calendar months prior notice, or immediately by the commissioner under subdivision 2d.

• Prohibits agencies from refusing to enter into housing support agreements or limiting availability based solely on the medical assistance program type, establishment size, capacity, location, zoning classification, or building type not otherwise prohibited.
