Commissioner of human services must apply to the federal secretary of health and human services for a 1115 demonstration waiver within 120 calendar days of the bill's effective date.

Application must request coverage for substance use disorder treatment services in state prisons, county jails, and other secure settings, including screening, assessment, brief intervention, and medications for opioid use disorder (buprenorphine).

Services to be covered include certified peer recovery support services, culturally specific recovery supports, American Society of Addiction Medicine levels of care, and referral to substance use disorder treatment upon release.

Commissioner must consult with the commissioner of corrections, sheriffs, lead agencies, and individuals with lived experience of incarceration when preparing the waiver application.

Services must comply with the Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities Act (Public Law 115-271, section 5032) and federal guidance.
