H.F. 4675 Summary

• Commissioner of human services must prepare legislation by July 1, 2024 for the 2025 legislative session to permit reimbursement of up to eight hours of overtime per week per worker beyond the maximum monthly reimbursable hours for personal care assistants and community-first services and supports workers.

• Commissioner must submit to federal Centers for Medicare and Medicaid Services by January 1, 2025 any necessary waiver changes or state plan amendments to enable overtime reimbursement for these workers.

• Commissioner must prepare legislation by July 1, 2024 to permit reimbursement for overnight asleep or awake staffing for personal care assistants and community-first services and supports workers in the same manner as direct support professionals under four specified disability waivers.

• Commissioner must prepare legislation by July 1, 2024 to permit reimbursement for shifts of up to 80 consecutive hours for personal care assistants and community-first services and supports workers when compliant with federal and state labor laws.

• All sections become effective the day following final enactment.
