County attorneys must disclose all communications with expert witnesses to peace officers when reviewing, investigating, or prosecuting an officer-involved death where the officer is a defendant or subject and the expert is assessing whether use of deadly force was justified under section 609.066.

Disclosure includes all reports, photographs, video, evidence, emails, letters, written communications, accurate summaries of meetings and phone calls, and all draft reports provided by the expert witness.

County attorneys must make disclosures within ten days of each communication with the expert witness.

County attorneys must supplement or correct any disclosure in a timely manner if they learn the disclosure is incomplete or incorrect in any material respect.

The law is effective the day following final enactment and applies retroactively to all ongoing reviews, investigations, or prosecutions at that time.
