Amends Minnesota Statutes 2022, section 245D.091, subdivisions 3 and 4 to modify qualifications for positive support analysts and positive support specialists providing services under brain injury, community access for disability inclusion, community alternative care, and developmental disabilities waiver plans.

Positive support analyst qualifications require a baccalaureate degree or higher in social services or nursing, mental health practitioner credentials, or board certification as a behavior analyst, plus four years of supervised experience with functional behavior assessments and positive practices behavior support strategies.

Positive support analyst must complete 68 hours of training prior to hire or within 90 calendar days, including instruction in functional assessment, behavior function, positive practices design, intervention strategies, data analysis, and person-centered thinking.

Positive support specialist qualifications lowered to require an associate's degree in social services or nursing, or two years of supervised experience working with individuals exhibiting challenging behaviors and co-occurring mental disorders.

Positive support specialist must complete 42 hours of training prior to hire or within 90 calendar days; both roles require determination of competency by a positive support professional and must work under direct supervision of a positive support professional.

Both amendments become effective July 1, 2024, or upon federal approval, whichever occurs first.
