HF5032 Summary

• Creates a working group to study the prevalence, impact, and regulation of common interest communities (CICs) and homeowners associations (HOAs) in Minnesota, including their effects on safe and affordable housing access.

• Working group shall examine CIC and HOA fees, governing documents, board participation barriers, management practices, housing market impacts, racial disparities in homeownership, accessibility for persons with disabilities, and compare Minnesota's regulations to other states' best practices.

• Working group consists of 14 categories of members including 4 legislators, representatives from housing organizations and legal aid, attorneys, realtors, government officials, current and former board members, and current or recent CIC/HOA owners.

• Legislative Coordinating Commission shall facilitate the working group and convene the first meeting by July 15, 2024, with meetings subject to Minnesota Open Meeting Law.

• Working group must submit a final report by February 1, 2025, to legislative committees with jurisdiction over housing, commerce, and real property, including recommendations and draft legislation, and expires February 28, 2025.
