Adds a new provision allowing the commissioner to grant variances for child care center licensed capacity limits if the center's indoor space is within 100 square feet of what would be required for maximum enrollment based on staff numbers and qualifications.

Variance requests for licensed capacity must be submitted to the commissioner using the existing variance request procedures outlined in paragraph (a).

Maintains existing requirements that variance requests include reasons for non-compliance with rules, alternative equivalent measures to comply with rule intent, and the requested time period for the variance.

Preserves existing provisions on permanent variances, which expire when conditions change, and requires license holders to inform the commissioner of any modifications to conditions warranting the variance.

Commissioner's decisions on variance requests remain final and are not subject to appeal under chapter 14.
