School boards may renew an expiring capital projects referendum by board action instead of holding an election, if the annual amount and term remain the same as originally approved by voters.

Board renewal requires a recorded vote, written resolution, public meeting, and public testimony opportunity, with the resolution adopted by June 15 and becoming effective 60 days later.

A referendum can only be renewed by board action once; subsequent renewals require voter approval through election.

The school board must submit a copy of the adopted resolution to the commissioner and county auditor by September 1 of the year the resolution is adopted.

The bill takes effect the day following final enactment and amends Minnesota Statutes 2022, section 123B.63, subdivision 3.
