HF 5268 Summary

• Prohibits retailers and distributors from selling or offering for sale disposable electronic delivery devices (defined as electronic delivery devices with fixed or embedded batteries not easily removable by users) in Minnesota, effective January 1, 2025.

• Establishes civil penalties of up to $500 for first violations and up to $2,000 for subsequent violations per device when 50 or fewer devices are sold or offered; increases to up to $1,000 and $5,000 respectively when more than 50 devices are involved.

• Deems any disposable electronic delivery devices sold in violation subject to forfeiture under section 297F.21.

• Authorizes the attorney general to enforce the prohibition through injunctive relief, fines, penalties, and attorney fees, and classifies violations as violations of the Unlawful Trade Practices Act.

• Amends section 461.19 to clarify that local ordinances can provide more restrictive regulation of electronic delivery devices and requires 30 days' notice to licensees before local ordinance adoption or amendment, effective January 1, 2025.
