Correction orders and conditional licenses for programs licensed under both Chapter 245A and Chapter 245D must be specific to the service site or sites where violations occurred and cannot apply to other sites unless the commissioner provides an articulable basis.

The commissioner must inform license holders that their next audit or investigation will result in a conditional license if they fail or have any violations, and may only issue conditional licenses when the holder is willfully violating Chapter 245D.

The commissioner may reduce the conditional license period if the license holder demonstrates compliance before expiration and must refer license holders to legal assistance or other available resources when subject to enforcement action.

The commissioner must partner with culturally specific organizations to provide education on licensing requirements and staff training, and offer alternative dispute resolution services when license holders appeal correction orders.

By January 1, 2025, and annually thereafter, the commissioner must report to legislative committees on enforcement actions against license holders, including aggregated data on the self-identified race and ethnicity of those subject to enforcement and efforts to improve personnel diversity and cultural competency.
