All eligible individuals must be provided the opportunity to opt out of managed care enrollment, with the commissioner developing criteria for when choice limitations may be implemented in experimental counties.

Before limitation of choice is implemented, eligible individuals shall be notified and given the opportunity to opt out; those who do not opt out may only choose among demonstration providers.

The commissioner shall establish an enrollee support system providing counseling on choosing a managed care plan or opting out, assistance with enrollment, complaint access points, and help navigating grievance and appeals processes.

Persons with disabilities shall be enrolled in managed care under Medicare special needs plans unless the individual chooses to opt out, with enrollment and opt-out procedures established by the commissioner.

County-based health care purchasing programs are subject to the opt-out provision, allowing medical assistance eligible persons the same opportunity to decline managed care enrollment.
