SF122 - School Bus Seat Belts

• School buses purchased after December 31, 2023, must be equipped with approved lap and shoulder belts for each passenger seating position.

• School buses purchased before December 31, 2023, may optionally be equipped with either lap belts or lap and shoulder belts.

• The commissioner of transportation shall establish design and installation standards for seat belts that are exempt from standard rulemaking procedures under Minnesota Statutes chapter 14.

• Passengers or parents/guardians may opt out of seat belt use by providing written notice to the school district.

• School districts and bus operators cannot be held liable solely because an injured passenger was not wearing a seat belt, but remain liable for failing to maintain required equipment or comply with applicable laws and policies.
