Beginning in 2024, the commissioner shall adopt each new published edition of ASHRAE 90.1 or a more efficient standard for the commercial energy code.

Commercial energy codes adopted from 2024 to 2036 must incrementally move toward achieving an 80 percent reduction in annual net energy consumption by 2036, using ASHRAE 90.1-2004 as the baseline.

The commissioner must report annually by January 15 to legislative committees with jurisdiction over the energy code on progress toward the 80 percent energy consumption reduction goal.

Public utilities may continue to offer code support programs and claim energy savings from such programs under their energy conservation and optimization plans.
