• School districts and charter schools receiving student support services funding must develop plans to conduct developmentally appropriate evidence-based mental health and substance use disorder screenings for students in kindergarten through grade 12, effective July 1, 2024.

• Districts must obtain parental consent before conducting screenings and must notify parents of positive results, providing copies of results and community resources.

• Mental health and substance use disorder screening data cannot be used for instructional, academic, or disciplinary decisions and must be destroyed within 60 days of collection or upon parent notification, whichever is earlier.

• Student support personnel aid may be used to pay for mental health and substance use disorder screening costs, including screening attributable to both new and existing positions.

• The commissioner of education must provide districts and charter schools with evidence-based screening tools and resources, consulting with the commissioner of human services in tool selection.
