• Vehicle owners are guilty of a petty misdemeanor when operating at speeds 20 miles per hour or more above the posted speed limit, enforceable through automated traffic enforcement systems.

• Automated traffic enforcement systems must detect and record vehicle speed, produce photographs or video recordings, and record license plates; citations must be issued within 10 calendar days of the violation and include a copy of the recording.

• Local governments must hold a public hearing before implementing systems, adopt an ordinance governing their use, post warning signs, and issue only warnings during the first 30 days of operation.

• Before installing systems outside school or construction zones, local governments must determine high speed is a safety concern, ensure consistent and fair use throughout the jurisdiction, and prevent racially biased or discriminatory enforcement practices.

• Data collected through automated traffic enforcement systems are classified as private data on individuals; violations do not result in driver's license suspension or revocation, and do not restrict prosecution for other traffic law violations.
