• Adds a new exception to the community residential setting licensing moratorium for customized living settings that were operational on June 30, 2021, under brain injury or community access for disability inclusion waiver plans, with initial licensed capacity limited to four residents.

• Requires case managers to provide residents with information about service choices and locations, and limits licensing to settings where service costs are less than or equal to costs in the customized living setting as determined by the lead agency.

• Extends the exception to assisted living facilities licensed on or after August 1, 2021, that apply for community residential setting licenses before June 30, 2023.

• Creates a temporary rate increase for customized living services effective July 1, 2023, through June 30, 2025, calculated as 21.6 percent of current rates plus 78.4 percent of rates in effect as of June 30, 2017.

• Directs the commissioner to expedite processing of moratorium exception applications and increase licensed capacity to four for any existing settings licensed under the previous exception before bill enactment.
