S.F. No. 2411 - Summary

• Commissioner of health shall continue to deny requests for new licensed or certified nursing home beds, except under specified exceptions in subdivisions 3, 4a, or section 144A.073.

• Construction projects exceeding $1,000,000 must meet specific conditions: costs above threshold cannot be added to facility's appraised value or medical assistance reimbursement rate, unless approved through section 144A.073 process or meeting other enumerated exceptions.

• Projects approved under section 144A.073 after March 1, 2020 are subject to fair rental value property rate as described in section 256R.26.

• Nursing facilities may request amendments to approved projects within 15 months of receiving approval, with amendment costs capped at 10% above original approved cost estimate under specified circumstances (natural disaster, safety/durability conditions, legal requirement changes, or unforeseeable circumstances).

• All changes are effective retroactively from March 1, 2020.
