Amends Minnesota Statutes 375.08 to clarify that county boards must fill vacancies in county auditor, treasurer, recorder, sheriff, county attorney, surveyor, or coroner positions by appointment at a regular or special meeting.

Creates new statute 375.081 authorizing county boards to fill sheriff or county attorney vacancies through a special election as an alternative to appointment, with the election date determined by section 205.10, subdivision 3a.

Specifies that a person elected at the special election takes office immediately upon receiving the certificate of election, filing the required bond, and taking the oath of office, and serves the remainder of the unexpired term.

Prohibits use of the special election option if the vacancy occurs less than 84 days before the state primary in the year preceding the end of the term, in which case appointment procedures apply instead.

Maintains that a chief deputy or first assistant may perform all duties and functions of the office until the vacancy is filled by appointment by the county board.
