Commissioner of human services must submit amendments to federal Centers for Medicare and Medicaid Services by December 1, 2024 to allow indirect billing for individualized home supports services that do not require direct contact with service recipients.

Allowable tasks that may be billed without direct contact include researching and arranging transportation, coordinating health care access, arranging legal support and crisis prevention, collaborating with employers on employment maintenance, coordinating access to basic needs resources, ensuring independent living in recipient's home, and coordinating with other service providers.

Indirect billing is permitted only if services are necessary to ensure continuity of other necessary services and supports for the recipient.

Services may be billed if reasonable attempts have been made to directly involve the service recipient, or the recipient cannot be directly involved due to illness, injury, or other factors.

Services may be billed if the service recipient has made an informed choice to allow services to be provided without their direct contact.
