Assisted living facilities with six or fewer licensed residents are exempt from rental licensing regulations imposed by towns, municipalities, or counties.

Residential programs with six or fewer licensed residents are considered permitted single-family residential uses for zoning purposes, except those treating juveniles adjudicated delinquent for sex offenses (exemption does not apply to programs licensed before July 1, 1995).

Programs allowed under these provisions cannot be prohibited by restrictive covenants or similar restrictions that require occupants to be related or require owner occupancy.

Residential programs with six or fewer licensed residents that are actively serving residents are exempt from local rental licensing regulations.
