SF4044 Summary

• Modifies the definition of "assisted living facility" to include any facility that markets itself as assisted living, memory care, or dementia care regardless of other exemptions.

• Expands consumer protections for "exempt settings" (housing funded under federal programs for disabled or homeless individuals) by requiring compliance with assisted living facility standards including contract requirements, termination procedures, and resident bill of rights, effective January 1, 2025.

• Requires exempt settings to execute written subsidized assisted living contracts with residents complying with section 144G.50, with limited exceptions for specific contract subdivisions.

• Exempt settings must comply with restrictions on facility operations, handling of resident finances and property, contract terminations, housing nonrenewal, and coordinated moves, but exempts facilities owned or operated by counties or other government units from facility restriction requirements.

• Repeals previous subdivision 2 (contracts), subdivision 3 (termination of contract), and subdivision 9 (remedy) of section 325F.722, replacing them with expanded protections effective January 1, 2025.
