S.F. No. 4334 Summary

• Allows voters to select "none of the above" on general and special election ballots for governor, lieutenant governor, and all legislative offices, printed below the write-in line.

• "None of the above" option does not appear on primary ballots for legislative offices.

• Election judges must create separate ballot piles for "none of the above" votes during counting and report these votes on precinct and county canvass summary statements.

• If a majority of voters select "none of the above" for governor, lieutenant governor, or a legislative office, the county canvassing board and State Canvassing Board must not declare any candidate as elected to that office.

• Legislative seats where "none of the above" receives a majority are not considered vacant and cannot be filled under existing vacancy procedures; act becomes effective June 1, 2024.
