Commissioner of transportation may not require local units of government to pay for project costs incurred within trunk highway right-of-way that result from the project, including utility relocation costs.

Cost participation restrictions apply regardless of facility ownership, whether expenditures are for nontrunk highway purposes, or whether projects provide nontrunk highway system benefits; commissioner must identify nontrunk highway fund sources as necessary.

Requirements do not apply to costs resulting from agreements between the commissioner and local units of government for work in addition to the project design or scope under Minnesota Statutes section 161.38.

Effective July 1, 2024, with exemption for trunk highway projects included in the state transportation improvement program before July 1, 2024, for construction commencement in calendar year 2024.

General fund appropriation of unspecified amount for fiscal year 2025 to commissioner of transportation for trunk highway project costs ineligible for trunk highway fund payment, available until June 30, 2026, with base funding specified for fiscal years 2026 and 2027.
