Commissioner of human services must submit a 1115 demonstration waiver application to the Secretary of Health and Human Services within 120 calendar days of the effective date.

Application must request coverage for substance use disorder treatment services provided to individuals in state prisons, county jails, and other secure settings.

Requested services include screening and assessment, buprenorphine and other medications for substance use disorders, certified peer recovery support services, culturally specific recovery supports, appropriate levels of care, and referral to treatment upon release.

Commissioner must consult with the commissioner of corrections, sheriffs, lead agencies, and individuals with lived experience of incarceration when preparing the application.

Services must be consistent with the Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities Act (Public Law 115-271, section 5032) and federal guidance.
